Legal Processes
Litigation Process:
The litigation process begins when a plaintiff or prosecutor files a legal complaint or charge against a defendant. Once the case is filed, the defendant is formally notified through a summons and is given the opportunity to respond. The pretrial phase follows, during which both parties engage in discovery, take depositions, and file motions to clarify or resolve specific issues. If the case proceeds, it moves to trial, where evidence and arguments are presented before a judge or jury. After the trial, a judgment is issued, and the losing party may choose to appeal the decision if grounds exist.
Contract Enforcement Process:
When one party to a contract believes the other has failed to fulfill their obligations, they can initiate a breach of contract claim. In many cases, the parties first attempt to resolve the dispute through mediation or negotiation, exploring alternative dispute resolution methods to avoid court proceedings. If these efforts fail, the matter is taken to court, where the contract's terms and validity are examined. Once the court reaches a decision, remedies such as specific performance, damages, or other forms of enforcement may be ordered to ensure compliance.
